Competition Terms and Conditions
Entry to the Competition
This Competition is open to UK residents aged 18 years or over, excluding employees of O2 UK or any of their subsidiary companies or organisations, their families, agents or anyone else connected with this Competition. The Event is only open to those aged 18 years or over. Both Entrants and Guests must comply with this condition. O2 reserves the right to verify the eligibility of entrants and guests.
Entrants must be O2 customers on the day before the Competition opens and continue to be O2 customers for the duration of the Competition.
This Competition is open until 5 p.m. on Tuesday 29 April 2008 ("
Closing Date
"). To enter the Competition, entrants must set up a guest list on the Competition website, by following the instructions on the Competition website. Entrants will be required to provide the personal details indicated in the entry form. Only one Guest List per person allowed. "
Entrant
" means anyone who has successfully set up a Guest List and entered the Competition and "
Guest List
" means an Entrant's guest list.
These Terms and Conditions set out the rules that apply to this Competition and entry into this Competition, submission of a Guest Photo and/or attendance at the Event constitutes acceptance of these Terms and Conditions.
Guests and Guest Photos
Once an Entrant has successfully set up a Guest List, they will be provided with a unique passcode which they must provide to their guests in order for the guests to join their Guest List. Entrants will invite guests to join their Guest List by providing the Entrant's Guest List name and unique passcode.
To join an Entrant's Guest List, Guests must (a) submit a valid photograph of themselves to the applicable Guest List during the Competition Period by sending a photograph via MMS to the short code 63333 and (b) provide the Entrant’s unique passcode and their name. Only one photo per guest for any one given Guest List is allowed. Guests may submit a photo to more than one Guest List. "
Guest Photo
" means a photo that has been submitted to a Guest List and "
Guest(s)
" means anyone who has successfully submitted an eligible Guest Photo and validly joined a Guest List.
In order for a Guest Photo to be validly uploaded to a Guest List and therefore count towards the total number of Guests on a Guest List, it must comply with these Terms & Conditions. It is the responsibility of both the Entrants and the guests to ensure that photographs submitted to a Guest List comply with these Terms and Conditions.
Guest Photos must comply with the following conditions in order to be valid and join a Guest List:
be supplied as an image file and cannot exceed a file size of 2Mb;
not contain images of more than one person - of the person who is submitting it;
not contain images of people whose prior express consent has not been obtained;
not contain images of people who are under 18 years old;
not contain material which is copyrighted or features predominantly or solely a trademark or logo not owned or licensed by the Guest;
not contain material which is potentially offensive (including, but not limited to, because it is adult in nature), defamatory or in any way derogatory about O2, the artist or the Event or any other third party connected in any way with the Competition or be otherwise objectionable;
comply with O2's Web, WAP and i-mode® Terms and Conditions, including in particular those related to Acceptable Use and User Generated Content; and
be taken by the Guest.
O2 reserves the right to review the image(s) submitted, for suitability and compliance with these Terms and Conditions. If the Guest Photo does not comply with these Terms and Conditions it will be invalid and the applicable guest will not be eligible to join a Guest List or become a Guest (and therefore not count towards the number of Guests filling the Guest List). Invalid Guest Photos will either not be placed on the Guest List at all or may be disqualified by O2 at the end of the Competition. Any decision to allow or disallow Guest Photos will be made at O2’s sole discretion and such decision shall be final.
Guest Photos will be made available and may be viewed on the Guest List by the applicable Entrant and O2 and its agents. Entrants can view their Guest Lists and see the number of Guests on their Guest List during the Competition Period.
Following the Closing Date, some or all of the Guest Photos can be viewed on the Competition website by anyone. By submitting a Guest Photo, Guests consent to same. O2 may wish to use any Guest Photos to promote O2 and/or the Competition which may be broadcast, distributed and/or exploited by O2 on a free of charge basis only (the "Purpose"), and by submitting a Guest Photo Guests grant O2 a worldwide, royalty free licence for the Purpose. Guests acknowledge and agree that O2 may, in its sole discretion and without notice, adapt, reformat, edit, alter, tag or otherwise modify the Guest Photo for the Purpose. Unless agreed otherwise in writing, O2 will not make any payments to Guests or any third party for its use of the Guest Photos for the Purpose. Guests waive all moral rights existing in their Guest Photo in favour of O2. O2 does not claim ownership of the Guest Photos and the Guests continue to own the rights in their Guest Photos submitted to the Guest List . However, by submitting photos to the list, a worldwide, perpetual, irrevocable, royalty-free right and licence is granted to O2 to copy, use, reproduce, modify, adapt, publish, translate, sub-licence, create derivative works from, perform, play, make available to the public (on O2's services or in relation to O2 sponsorship properties), exploit, transmit, distribute in any media now known or later developed and otherwise deal in or with and exercise all copyright and publicity rights with respect to the Guest Photos for the full term of any rights that may exist only as required for the Purpose.
How To Win
There are 2 different major prizes with 2 major winners in total and 50 runner-up prizes, with one overall winner winning the VIP Party. The overall winner of the Competition and the recipient of the VIP Party will be the Entrant with the most number of valid, unique Guests on their Guest List on the Closing Date ("
VIP Party Winner
"). In the event that more than one Entrant has the same number of valid, unique Guests on the Closing Date, the winner will be chosen by a random draw from those Entrants. Second prize is 5 "Party Crasher" tickets to the Event and the winner will be the Entrant who has promoted their party in the most creative way, as determined by a judging panel ("
Party Crasher Ticket Winner
"). The winners will be notified on 30 April 2008 by telephone.
First prize for the VIP Party Winner is a VIP party for 100 guests at the Event, which is happening at the Venue on the date set out above. First Prize also includes the following:-
VIP party;
Access to the VIP area at The Indigo2;
O2 will provide a selection of Food and Beverage for the VIP guests;
Meet and Greet with Moby;
Second prize for the Party Crasher Winner is: 5 tickets to the Event
There are 50 runner-up prizes of a Moby CD for each of the top 50 Entrants with the next most number of Guests on their Guest List. These CDs will be allocated at random from Moby’s back catalogue.
Prizes do not include travel, accommodation or any other expenses incurred by the winner(s) or their guests.
The Event will be attended by the VIP Party Winner, their VIP guests and guests appearing on the VIP Party Winner’s Guest List who have successfully applied for tickets and the Party Crasher Winner and their guests, provided they all have valid tickets. The Event may also by attended by guests invited by O2 either via general ticket sales, prize giveaways, or other distribution methods. In entering the Competition, Entrants acknowledge and agree that they and their guests will not have exclusive access to the Event.
Going to the Event
The VIP Party Winner will have the opportunity to invite up to 100 of their friends to the Event. The individuals invited by the VIP Party Winner do not have to correspond with the Guests who are on the VIP Party Winner’s Guest List. The VIP Party Winner must provide O2 by 5 p.m. on 1 May 2008 with the names and contact details of their VIP Guests so that O2 can send them invites to the Event. On or around 2 May 2008, O2 will send invites to those VIP guests.
Guests who feature on the Winner’s Guest List will be notified by text on or around 2 May 2008 that the VIP Party Winner has won the Competition and will be invited to apply for a ticket to the Event by sending an RSVP via the Competition website. The first 1500 of these Guests who validly RSVP may receive a ticket to the Event. Guests who validly RSVP but are not one of the first 1500 will not automatically receive a ticket to the Event but will be placed on a stand-by list on a first come first served basis and may be contacted should tickets become available.
The Party Crasher Ticket Winner will have the opportunity to invite up to 4 of their friends to the Event. The individuals invited by the Party Crasher Ticket Winner do not have to correspond with the Guests who are on their Guest List. The Party Crasher Ticket Winner must provide O2 by 5 p.m. on 1 May 2008 of the names and contact details of their Party Crasher Ticket Guests so that O2 can send them invites to the Event. On or around 2 May 2008, O2 will send invites to those guests.
All guests who have been sent an invite must RSVP by 12 a.m. on 3 May 2008. To validly RSVP, all guests must text the keyword to 63333 by 11.59pm on 3 May 2008 and they will receive a unique passcode that may only be used once, and a URL that re-directs them to the Ticketmaster promotions page (via the competition website). This URL and password provides the recipient with the chance to get a ticket provided they apply by [11.59pm on 3 May 2008]. Capacity restrictions may apply during busy periods. Texts sent to this shortcode are charged at standard network rates.
All Guests who validly RSVP and have been successful in their ticket application will be notified on or around 3 May 2008 if they are eligible to receive a ticket to the Event. Mobile tickets will be issued on or around 6 May 2008 by Ticketmaster. Any guests who fail to RSVP correctly or do not RSVP within the required timescales will not receive a ticket to the Event.
A few days before the Event, all guests who have been issued with tickets will be sent a reminder and asked to advise if they are no longer able to attend the Event. If they confirm they are no longer able to attend, their ticket will be cancelled and the first guest on the stand-by list will be sent another invite and asked to RSVP in order to receive a ticket to the Event.
The Event
Entrance to the Event is subject to the standard conditions of entry to The O2, which can be viewed online at

Official tickets will be required in order to enter the Event. Guests and winners who are allocated tickets will receive a unique passcode sent to their mobile phone that may only be used once and which will act as a ticket to the Event.
DO NOT LOSE OR FORWARD THIS PASSCODE
as it provides ONLY ONE recipient with entry to the Event.
Only one entry per passcode.
Guests and the major winners will be required to show their unique passcode at the entrance to the Event and may also be required to present I.D. to prove they are over 18. Capacity restrictions may apply during busy periods and except in the case of the major winners, VIP Guests and Party Crasher Ticket Guests, entry will operate on a first come first served basis.
General
Events may occasionally be cancelled for reasons outside O2’s control. O2 will endeavour to promptly update any relevant information but cannot issue refunds for texts or MMS sent before this occurs. O2 will not be liable for any change of date, venue, artist, or cancellation of the Event. In the event of cancellation O2 reserves the right to invoke clause 28.
O2 reserves the right to provide substitute prizes of similar value (such alternatives to be at O2’s sole discretion) should any part of the prizes become unavailable for reasons beyond its control. The meet & greet is only a chance to meet Moby and is not guaranteed to take place. It is subject to Moby’s availability, willingness and ability to attend and participate. It may be cancelled or curtailed with no notice for reasons including (but not limited to) Moby’s health, schedule, time and/or venue constraints, other commitments, or those of his/her family. In the event of cancellation or curtailment no alternative or re-arrangement will be possible and no compensation will be payable. Cash or credit alternatives will not be offered. The prizes and tickets are not transferable.
In the event of fraud, abuse, and/or an error affecting the proper operation of the Competition, including the allocation of more prizes or tickets than are available and/or if O2 reasonably believes that the purpose of obtaining the tickets is to enable commercial re-sale of the tickets, O2 reserves the right to end or suspend the promotion; amend these terms & conditions; declare void the notification of winners or guests; cancel tickets and/or to allocate available prizes and/or tickets by conducting a simple draw from all wrongly allocated winners and ticket recipients.
O2 accepts no responsibility for the failure of the winners or their guests to attend the Event or take-up the prizes or attend the meet and greet however so caused in the manner or time specified and no alternative or replacement will be offered.
O2 accepts no responsibility for incorrectly completed, lost or delayed entries, text messages, MMS messages, notices, acceptances, RSVPs, tickets, passcodes or other documents related to the Competition or prize. Entries and Guest Photos not complying with these terms and conditions will be invalid. The instructions provided at the point of entry or otherwise provided by O2 form part of the terms & conditions of this Competition, and in the event of a conflict, these terms & conditions take precedence.
Invites to the Event and promotional messages about the Event may be forwarded by persons other than O2 and the content of those messages may be amended by those persons. Any person sending invites or messages about the Event accepts full responsibility for the content of those messages and O2 accepts no responsibility for, and will not be liable for any loss or damage which occurs as a result of, any third party content contained in invites or promotional material about the Event.
The names of the winner(s) may be obtained by sending a stamped self-addressed envelope detailing your request to: Fill the dance floor with Moby Competition, Telefónica O2 UK Limited, 260 Bath Road, Slough, SL1 4DX.
If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
The winners and/or their guests may be required to participate in publicity connected with this promotion and it is a condition of entry that Entrants agree to their name being made publicly available if they win.
Information provided to O2 will be used in connection with administering this promotion which may include exchanging information and data regarding applications for tickets and unique passcodes with third party service providers and will be subject to O2's Data Protection and Privacy Statement, the current version of which can be found at o2.co.uk/termsconditions/o2privacypolicy and shall be deemed incorporated into these terms and conditions.
In respect of all matters relating to this Competition and any decisions regarding ticket allocation, O2’s decision is final and no correspondence will be entered into.
This Competition is governed by English Law and the English courts shall be the courts of exclusive jurisdiction.
