Terms and Conditions - Fans from the 90s
This promotion is open to O2 customers who are UK residents aged 18 years or over, excluding employees of O2 UK, or any of their subsidiary companies or organisations, their families, agents or anyone else connected with this promotion. O2 UK reserves the right to verify the eligibility of entrants.
The promotion is a Competition whereby O2 will display on its blueroom photo(s) of the crowd taken by Philip Ollerenshaw at Take That concerts in the 1990s ("the 1990s Photos"). O2 customers who believe they can identify themselves in the photo(s), may enter the competition for a chance to win one of the prizes.
To enter, entrants must:
Identify which of the 1990s photos they believe they are in, their approximate location, and their appearance (i.e. colour of clothing) in the photo;
submit a current photo of themselves, sufficient that O2 can use it to identify and match the entrant and the person in the 1990s Photo;
provide details of the venue in which the 1990s Photo which they claim includes them was taken; and
warrant to O2 that they are the person in the 1990's photo
O2 will then select 5 Winners. The winners will be the 5 eligible entrants whom it believes (in its absolute discretion) to be the closest identifiable match to the photo submitted by the entrant, and the person they claim to be in the 1990s Photo (the "Judging Criteria"). Entries for the Competition close at 5:00pm (GMT) on Monday 17 December 2007 The judges' decision is final and no explanation will be given or correspondence will be entered into.
The winners will win one of 5 pairs of tickets to Take That's gig at The O2 on New Year's Eve. For the avoidance of doubt no travel, accommodation or other expenses incurred by the winners are included in the Prize. 02 shall take no liability for the failure of a winner to attend the concert on the appropriate date / time.
Entrants must submit photo by emailing it to

between 4th December and 5:00pm (GMT) 17th December 2007 and follow the entry instructions on the site. All entrants must successfully upload their photo before the competition close date to be eligible to win a Prize.
To be eligible, the photo emailed to

must:
satisfy the Judging Criteria;
be supplied as an image file and cannot exceed a file size of 3Mb;
not contain images of people whose prior express consent has not been obtained;
not contain material which is copyrighted or features predominantly or solely a trademark or logo not owned or licensed by you;
not contain material which is potentially offensive (including because it is adult in nature), defamatory or in any way derogatory about the O2, 02, Take That, or otherwise objectionable.

The O2 will review the image(s) submitted, for suitability and compliance with these terms and conditions, before any image will be entered in the Competition. If the image does not comply with these terms it will not be entered into the Competition and you will not be eligible to win a Prize. This decision shall be at the judges sole discretion.
The Competition Winners will be chosen by the judging panel in the 7 Days following the closing date. Competition Winners will be notified by telephone using the details provided by them at the time of entry. If any winners cannot be contacted, or prizes are unclaimed or declined within a reasonable period, the O2 will select a replacement winner, or winners, using the Judging Criteria.
The names of the winners may be obtained by sending a stamped self-addressed envelope detailing your request to: Countdown to Midnight (Photo) Promotion, O2 (UK) Limited, 260 Bath Road, Slough, SL1 4DX.
O2 reserves the right to provide substitute prizes of similar value (such prizes to be selected at O2's sole discretion) should any of the specified prizes become unavailable for reasons beyond its control. Cash or credit alternatives will not be offered. The prizes are not transferable.
In the event of fraud, abuse, and/or an error affecting the proper operation of the promotion, including the allocation of more prizes than are available, O2 reserves the right to end or suspend the promotion; amend these terms & conditions; declare void the notification of winners; and/or to allocate available prizes by conducting a simple draw from all wrongly allocated winners.
O2 accepts no responsibility for incorrectly completed, lost or delayed entries, notices, acceptances, tickets or other documents related to the promotion or prize. Entries not complying with these terms and conditions will be invalid. The instructions provided at the point of entry form part of the terms & conditions of this Competition, and in the event of a conflict, these terms & conditions take precedence.
If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
The winners may be required to participate in publicity connected with this promotion and it is a condition of entry that entrants agree to their name being made publicly available if they win.
Information which you provide to O2 is also subject to O2's Data Protection and Privacy Statement, the current version of which can be found at

and shall be deemed incorporated into these terms and conditions.
The O2 does not claim ownership of the Entry or Entries you submit and you continue to own the rights in such Entry or Entries. However, by submitting your entry, you hereby grant to O2 a worldwide, perpetual, irrevocable, royalty-free right and licence to copy, use, reproduce, modify, adapt, publish, translate, sub-licence, create derivative works from, perform, play, make available to the public (on O2's services or in relation to O2 sponsorship properties), exploit, transmit, distribute in any media now known or later developed and otherwise deal in or with and exercise all copyright and publicity rights with respect to the Entry or Entries for the full term of any rights that may exist only as required for publicity connected with this promotion.
Entry into this promotion constitutes acceptance of these terms and conditions. O2's decision is final and no correspondence will be entered into.

. O2 will not be liable for any change of date or venue or cancellation of any event. O2 will not be responsible for any inability of the prize winners or their guests to take up the prizes, and no alternative or replacement will be offered. Prizes are not transferable.
This promotion is governed by English Law.
